The Right of Withdrawal allows the Consumer to withdraw from any distance purchase within fourteen (14) working days and receive a full refund of the purchase price without any penalty, as provided for by Italian Legislative Decree No. 185 of 22 May 1999, which also applies to purchases made via the Internet.

The only non-refundable costs are the shipping charges, which remain excluded from the provisions of Legislative Decree No. 185/1999.

The Customer has the right to withdraw from the purchase agreement for any reason, without providing any explanation and without incurring any penalty, except in the cases of exclusion specified below. To exercise this right, the Customer must notify PhytoItalia S.r.l. within 14 days of receiving the Products.

 

After completing the purchase, should the Customer wish to exercise the Right of Withdrawal, the following procedure must be followed:

After verifying the integrity of all Product components and any accompanying items, PhytoItalia will refund the amount paid, excluding shipping costs. The refund will be processed within 14 days following completion of the above verification.

The Right of Withdrawal applies only to the Product in its entirety. Therefore, if the Product consists of several components or parts, it is not possible to withdraw from the purchase of only part of the Product.

 

The Right of Withdrawal shall be forfeited if the returned Product is not intact, including, but not limited to, the following cases:

  1. the original packaging is missing;
  2. components or accessories that form an integral part of the Product are missing;
  3. the Product has been damaged for reasons other than transportation.

The Right of Withdrawal does not apply in the following cases, pursuant to Article 59 of Italian Legislative Decree No. 21/2014:

  1. orders placed by non-consumer customers and/or orders requiring an invoice;
  2. orders for Products made to measure or clearly personalised;
  3. orders for Products liable to deteriorate or expire rapidly;
  4. orders for sealed Products that have been opened after delivery.
